TERMS & CONDITIONS

Anna Smeda Art LLC — annasmedaart.com

Last Updated: August 20, 2026

These Terms & Conditions (“Terms”) govern your use of annasmedaart.com (the “Website”) and any purchase you make from Anna Smeda Art LLC (“Anna Smeda Art,” “we,” “us,” or “our”).

By accessing the Website, submitting information, or placing an order, you agree to these Terms. If you do not agree, please do not use the Website or purchase its products.

1. Eligibility

You must be at least 18 years old to place an order through the Website. If you are under 18, a parent or legal guardian must place the order on your behalf and confirm that they are legally authorized to use the selected payment method.

By placing an order, you confirm that the information you provide is accurate and that you are legally authorized to use the selected payment method.

2. Artwork and Product Information

We make reasonable efforts to describe and display our original artwork, prints, dimensions, materials, colors, and other product details accurately.

Because computer and mobile screens display colors differently, the colors of the artwork you receive may vary slightly from the colors shown on the Website. Handmade and original artwork may also include natural variations, textures, brushwork, surface irregularities, or other characteristics that are part of the artwork and are not considered defects.

Product descriptions, dimensions, photographs, prices, and availability may be corrected or updated at any time.

3. Orders and Acceptance

Submitting an order does not guarantee that the order has been accepted. We reserve the right to refuse or cancel an order because of:

• Incorrect pricing or product information

• Artwork that is no longer available

• Suspected fraud or unauthorized payment

• Shipping limitations

• Errors affecting the order

• Any other lawful business reason

If payment has already been collected for a canceled order, we will issue a refund to the original payment method.

Original artwork is one of a kind. Placing an item in a cart does not reserve it. An artwork is not sold until payment has been successfully completed and the order has been accepted.

4. Prices, Payments, and Taxes

All prices are listed in U.S. dollars unless otherwise stated.

Prices may change without notice, but a change will not affect an order that has already been accepted.

Payments are processed securely by Stripe or another payment processor displayed during checkout. We do not receive or store complete payment-card numbers.

You are responsible for applicable sales tax and any other charges displayed at the checkout. Standard shipping within the United States is free.

5. Shipping and Delivery

We currently ship only within the United States unless otherwise stated on the Website or agreed to by us in writing.

We generally process orders within 14 business days after payment is successfully completed. Processing time does not include carrier transit time. If we cannot ship within the stated timeframe, we will notify you and provide the option to consent to the delay or cancel the order for a full refund, as required by applicable law.

Estimated delivery dates are not guaranteed. Carrier delays, weather, holidays, incorrect addresses, and circumstances outside our reasonable control may affect delivery.

Complete shipping terms, including information about tracking, insurance, damaged packages, address errors, and lost shipments, are provided in our Shipping Policy, which is incorporated into these Terms.

6. Force Majeure

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, fire, supply shortages, carrier disruptions, labor disputes, government actions, or other circumstances that make fulfillment impracticable.

If such an event prevents us from fulfilling an order, we will notify you and provide any cancellation or refund rights required by applicable law. This section does not limit rights that cannot legally be waived.

7. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by our Returns & Refunds Policy, which is incorporated into these Terms.

Please review that policy before making a purchase. Contact us promptly if artwork arrives damaged, incorrect, or materially different from what you ordered.

8. Ownership of Artwork and Copyright

Purchasing an original artwork or print gives you ownership of the physical item only. It does not transfer the copyright or any intellectual-property rights associated with the artwork.

Unless we provide written permission, you may not:

• Copy, reproduce, scan, or photograph the artwork for reproduction, resale, commercial distribution, or other commercial use

• Use the artwork for commercial, advertising, branding, merchandising, or promotional purposes

• Create derivative products or digital files based on the artwork

• Use Website images, videos, writing, logos, or designs for commercial purposes

• Claim the artwork or Website content as your own

Anna Smeda Art LLC retains all copyright, reproduction, licensing, and other intellectual-property rights in the artwork and Website content.

You may display purchased artwork for personal, noncommercial use and may share personal photographs of it on social media, provided that you do not misrepresent authorship or use the images commercially.

9. Website Content

The Website and its contents—including artwork images, photographs, videos, text, graphics, logos, product descriptions, page designs, and downloadable materials—are owned by or licensed to Anna Smeda Art LLC and are protected by applicable copyright, trademark, and other intellectual-property laws.

You may view the Website for personal, noncommercial purposes. No Website content may be copied, downloaded, republished, modified, distributed, or commercially exploited without prior written permission.

10. Prohibited Uses

You may not use the Website:

• For unlawful, fraudulent, or deceptive activity

• To violate another person’s rights

• To interfere with the Website’s operation or security

• To introduce viruses, malicious code, or harmful technology

• To scrape, harvest, or collect Website content or visitor information without authorization

• To attempt unauthorized access to the Website, accounts, systems, or data

• To impersonate another person or provide false information

• To reproduce or commercially exploit our artwork or content without permission

We may restrict or terminate access to the Website when we reasonably believe these Terms have been violated.

11. Customer Communications and Submissions

If you send us messages, reviews, testimonials, photographs, or other materials, you confirm that you have the right to submit them and that they do not violate another person’s rights.

We will not publicly use your name, photograph, testimonial, or submitted content for advertising or promotional purposes without permission, except when the content was voluntarily posted publicly and shared using ordinary social-media features.

Personal information submitted through the Website is handled according to our Privacy Policy.

12. Third-Party Services and Links

The Website may contain links to or use services operated by third parties, including payment processors, shipping carriers, email providers, analytics services, and social-media platforms.

We do not control and are not responsible for the availability, content, security, policies, or practices of third-party websites and services. Your use of those services may be governed by their own terms and privacy policies.

13. Website Availability and Accuracy

We try to keep the Website accurate, secure, and available, but we do not guarantee that it will always operate without interruption, delay, technical problems, or errors.

We may modify, suspend, discontinue, or restrict any part of the Website without notice when reasonably necessary.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis.

We do not guarantee that the Website will be uninterrupted, error-free, completely secure, or free from harmful components. We do not guarantee that Website content will always be complete, current, or suitable for every purpose.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, Anna Smeda Art LLC and its owners, employees, representatives, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of—or inability to use—the Website or products purchased through it.

Where liability cannot legally be excluded, our total liability relating to a particular purchase will not exceed the amount you paid for that purchase, except where applicable law requires otherwise.

These limitations do not apply to liability that cannot legally be limited or excluded.

16. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, liabilities, or reasonable expenses resulting from your unlawful use of the Website, your violation of these Terms, or your infringement of another person’s rights.

17. Privacy and Cookies

Our collection and use of personal information are explained in our Privacy Policy.

Our use of cookies and similar technologies is explained in our Cookie Policy. Where required, non-essential cookies will be used only after you provide consent through our cookie banner or preference settings.

18. Governing Law

These Terms are governed by the laws of the State of New Jersey and applicable federal laws of the United States, without regard to conflict-of-law principles.

Nothing in this section removes consumer rights or protections that apply to you under mandatory law.

19. Dispute Resolution

Any dispute arising from these Terms or your purchase will first be addressed informally by contacting us. If a dispute cannot be resolved informally, it will be brought in the state or federal courts located in New Jersey, and you consent to that jurisdiction, except where mandatory consumer-protection law requires otherwise.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be interpreted or limited as closely as legally permitted to its intended purpose.

21. No Waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

22. Changes to These Terms

We may update these Terms when our Website, products, business practices, or legal obligations change.

The revised version will be posted on this page with a new “Last Updated” date. Your continued use of the Website after an update means that the revised Terms apply to your future use and purchases.

Material changes will not retroactively alter an order that was already accepted unless required by law or agreed to by both parties.
